1. Scope of Application

1.1 The following general terms and conditions apply to all contracts between ShowSlot Touring GmbH (Hanauer Landstraße 114-116, 60314 Frankfurt am Main, support@showslot.net) and Bavaria Live Promotion GmbH (Wörthstraße 13, 97082 Würzburg, info@blp.live) (hereinafter referred to as the ORGANISER) and visitors to events held by the ORGANISER (hereinafter referred to as visitors or attendees).

1.2 For the purposes of these terms and conditions, visitors also include purchasers and holders of tickets that entitle the bearer to admission to an event held by the ORGANISER, regardless of whether they attend or have attended the respective event.

2. Purchase of Tickets

2.1 Tickets for the ORGANISER's events can be purchased in advance or at the box office.

2.2 Advance sales are handled by the ticketing service provider CTS EVENTIM (CTS Eventim AG & Co. KGaA, Contrescarpe 75A, 28195 Bremen, info@eventim.de). Please also note CTS EVENTIM's general terms and conditions, which may apply alongside these terms and conditions.

2.3 Box office ticket sales begin approximately 1 hour before the start and close approximately 15 minutes before the start of the respective event. A box office is not offered for all events.

2.4 The resale of one or more tickets purchased for an event of the ORGANISER for commercial purposes is prohibited. In the event of a violation, the ORGANISER reserves the right to exclude the responsible party or parties from future ticket purchases and to deny admission to the event to persons holding such a ticket, without any entitlement to compensation.

3. Right of Access, Admission to the Event, Admission Checks

3.1 Only persons who present a valid ticket for the respective event of the ORGANISER upon admission are entitled to access.

3.2 The ticket entitles the holder to a single visit to the event indicated on the ticket on the relevant event day and becomes invalid once the event ends or - unless otherwise determined on site for the specific event - upon leaving the respective event.

3.3 In the case of personalised tickets, only the person whose first and last name is printed on the ticket is entitled to admission. The ORGANISER is entitled to request a valid identity card in order to verify the person's identity. However, the ORGANISER is not obliged to verify the visitor's identity. If the visitor refuses to present their identity card, or if verification of identity is not possible for other reasons outside the ORGANISER's area of responsibility, the ORGANISER is entitled to refuse access to the event. In this case, a refund of the ticket price is excluded.

3.4 For reduced-price tickets, the ORGANISER is entitled to request presentation of a valid proof of eligibility. If the visitor does not present a valid proof of eligibility, the ORGANISER is entitled to refuse admission until the difference to the respective standard price within the same category has been paid.

3.5 As a general rule, there is no right to admission after the performance has begun. At its own discretion, the ORGANISER may grant the visitor admission at a suitable point in time after the performance has begun. In this case, no partial or full refund of the ticket price will be made.

3.6 At its own discretion, the ORGANISER is entitled to refuse admission to persons who are visibly under the influence of alcohol, drugs or medication and who can therefore be expected to disrupt the course of the event. In this case, a refund of the ticket price is excluded.

3.7 The ORGANISER is entitled, at its own discretion, to carry out admission checks. The contents of bags or similar containers must be disclosed voluntarily upon admission.

3.8 Carrying weapons or other dangerous objects is prohibited. Visitors found to be in possession of weapons or other dangerous objects will be refused admission to the event. In this case, a refund of the ticket price is excluded.

4. Categories and Seating

Unless expressly stated otherwise on the ticket, seating within the respective seating category is freely chosen for all of the ORGANISER's events. There is no entitlement to a specific seat or to multiple adjoining seats. Hall or venue floor plans are for orientation purposes only and do not represent a true-to-scale depiction of the venue.

5. House Rules and Instructions from the ORGANISER

5.1 The ORGANISER exercises house rules at all events at the respective venues. Instructions from the ORGANISER's staff and security personnel must be followed. The ORGANISER is entitled to exclude from the event any visitors who repeatedly act in violation of the house rules and/or express instructions of the ORGANISER or its staff and security personnel. Visitors excluded from the event must leave the event immediately. In this case, a refund of the ticket price is excluded.

5.2 In particular, the ORGANISER is entitled to exclude from the event any visitors who repeatedly disrupt the event or harass other visitors.

5.3 Smoking is prohibited on the venue premises.

5.4 Bringing your own food and drinks is prohibited.

5.5 Mobile phones or other devices capable of disrupting the performance acoustically or in any other way must be switched off before the event begins and may only be switched back on after the event has ended.

6. Photo and/or Audio Recordings

6.1 Making photo and/or audio recordings is prohibited throughout the entire event unless expressly permitted by the ORGANISER. Violations may be subject to civil and criminal prosecution.

6.2 Visitors who make photo and/or audio recordings during an event without the ORGANISER's express permission may, at the ORGANISER's discretion, be excluded from the event. In this case, a refund of the ticket price is excluded.

7. Right of Withdrawal, Return and Exchange of Tickets

7.1 Advance sales are handled by our partner CTS EVENTIM, which is also responsible for operating the web shop and brokers the sale as a commission agent. Please therefore also note CTS EVENTIM's general terms and conditions for advance sales, as well as CTS EVENTIM's notices on withdrawal, return and exchange of tickets, all of which are available here and in CTS EVENTIM's web shop. Upon completion of the ticket purchase in CTS EVENTIM's web shop, a contract is concluded between the purchaser and the ORGANISER.

7.2. As a general rule, there is no entitlement to a return or exchange of tickets vis-à-vis the ORGANISER. Ticket purchases, including online purchases, are excluded from the right of withdrawal in Germany, Austria and Switzerland. Once the terms and conditions have been confirmed and the BUY TICKETS NOW button has been clicked, withdrawal from or cancellation of the contract by the visitor is no longer possible.

7.3 If an event is postponed for reasons beyond the ORGANISER's control, tickets remain valid for the rescheduled event. If it is demonstrably unreasonable or impossible for the visitor to attend the event on the rescheduled date, the ORGANISER is entitled to offer the visitor the opportunity to attend the respective event on another date within the season. In this case, the visitor may choose to exchange the ticket or return it for a voucher in the amount of the purchase price. This voucher can be redeemed for any of the ORGANISER's shows, subject to availability, and is valid for 3 years from the end of the year in which the voucher was issued. Travel and accommodation costs cannot be reimbursed under any circumstances.

7.4 If an event is cancelled for reasons beyond the ORGANISER's control, the ORGANISER will make efforts to reschedule the event to an alternative date. Tickets purchased for the cancelled event remain valid for the rescheduled date. If it is not possible for the visitor to attend the event on the rescheduled date, the ORGANISER is entitled to offer the visitor the opportunity to attend the respective event on another date within the season. In this case, the visitor may choose to exchange the ticket or return it for a voucher in the amount of the purchase price. This voucher can be redeemed for any of the ORGANISER's shows, subject to availability, and is valid for 3 years from the end of the year in which the voucher was issued.

7.5 It does not constitute a cancellation or abandonment of an event if the ORGANISER recasts a role for the respective event, even at short notice.

7.6 The ORGANISER reserves the right to cancel an event due to insufficient demand no later than 10 working days before the scheduled date. In the event of a cancellation, visitors will be informed immediately. Any ticket fees already paid will of course be refunded without delay. Where possible, the ORGANISER will offer an alternative date.

8. Vouchers

8.1 From time to time, we offer the option of purchasing vouchers in advance. Voucher sales are also handled via CTS EVENTIM; please refer to clause 7.1 in this respect.

8.3 The voucher can only be redeemed for the purchase of tickets to events held by ShowSlot Touring GmbH. The general terms and conditions in effect at the time of purchase apply to the purchase of the ticket.

8.4 If the voucher value exceeds the order value, the voucher value is automatically reduced by the amount redeemed. The remaining voucher value can be redeemed for a further purchase in accordance with this clause 8.

8.3 The voucher can only be specified or redeemed as a payment method before completing a ticket purchase. Subsequent offsetting against tickets already purchased is not possible.

8.4 The voucher is valid for 3 years from the end of the year in which it was issued.

8.5 Clause 2.4 of these general terms and conditions applies.

9. Validity and Application of these Terms and Conditions

Services and offers of the ORGANISER are provided exclusively on the basis of these general terms and conditions. As against businesses, these general terms and conditions therefore also apply to all future business relationships, even if not expressly agreed again. Any inclusion of a customer's general terms and conditions that conflict with our general terms and conditions is hereby objected to in advance.

Please note that advance sales are handled via the web shop and are the responsibility of our partner CTS EVENTIM. In addition to the ORGANISER's general terms and conditions, CTS EVENTIM's general terms and conditions apply, as do CTS EVENTIM's notices on withdrawal, return and exchange of tickets, all of which are available here and in CTS EVENTIM's web shop.

10. Set-Off and Right of Retention

10.1 The visitor is only entitled to a right of set-off if the counterclaim has been legally established, is undisputed or has been acknowledged by us, or stands in a close synallagmatic relationship to our claim

10.2 The right of retention may only be exercised insofar as the counterclaim arises from the same contractual relationship.

11. Liability

11.1 Unlimited liability: The ORGANISER is liable without limitation for intent and gross negligence, as well as in accordance with the German Product Liability Act. The ORGANISER is liable for slight negligence in the case of damages resulting from injury to life, body or health.

11.2 In all other respects, the following limited liability applies: In cases of slight negligence, the ORGANISER is only liable for breach of a material contractual obligation, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely (cardinal obligation). Liability for slight negligence is limited in amount to the damages foreseeable at the time the contract was concluded and which typically must be expected to occur.

11.3 The above limitation of liability also applies for the benefit of the ORGANISER's officers, employees and vicarious agents.

12. Notice on Out-of-Court Dispute Resolution

12.1 The European Commission provides a platform for online dispute resolution. This gives consumers the opportunity to resolve disputes related to their online order without first involving a court. The dispute resolution platform can be found at the external link http://ec.europa.eu/consumers/odr/.

12.2 The ORGANISER strives to settle any disagreements arising from contractual matters amicably. Beyond this, the ORGANISER is not obliged to take part in a dispute resolution procedure and cannot offer visitors participation in such a procedure.

13. Final Provisions

13.1 Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions.

13.2 Contracts are governed exclusively by German law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the country in which the visitor habitually resides remain unaffected by this choice of law (in particular with regard to the conclusion of the contract and warranty rights).

13.3 If the visitor is a merchant, a legal entity under public law, or a special fund under public law, the ORGANISER's place of business shall be the place of jurisdiction for all disputes arising from or in connection with contracts.
